Published in compliance with Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, and in particular Article 10. Accessing, browsing and using the BLACKBAU website implies tacit and unreserved acceptance of all provisions of this legal notice.

02Purpose
This legal notice governs access to, browsing of and use of the website, without prejudice to BLACKBAU's right to modify its presentation, configuration and content, as well as the conditions required for access or use. Access to or use of the website after such changes take effect implies their acceptance. Access to certain content and the use of certain services may be subject to particular conditions which, where applicable, replace, complete or modify this legal notice.
03The Website
Through the website the user may: register as a platform user and complete identity verification (KYC); access information on the services and investment projects available; explore the tokenized-asset marketplace and consult the financial, documentary and legal information of each project; acquire, send and receive tokens in tokenized investment projects; manage their wallet and consult their transaction history; create and publish tokenization projects as a promoter user; access their private user area; and contact support at Hola@blackbau.com.
04Access and Registration
Access to the website content is entirely free of charge. However, to operate on the platform the user must first complete the registration and identity verification (KYC) process. Where the user provides personal data through any of the forms, they must first accept the Privacy Policy. BLACKBAU is under no circumstances responsible for the truthfulness of the data provided by users, each of whom is solely responsible for the consequences of any inaccuracy.
05Intellectual and Industrial Property
BLACKBAU owns or holds the corresponding licences over the intellectual and industrial property rights required to operate the website and over all content offered on it, including texts, photographs, illustrations, logos, marks, graphics, designs and interfaces. Access, browsing and use of the website do not imply any waiver, transfer, licence or assignment of those rights. It is prohibited to modify, copy, reproduce, publicly communicate, transform or distribute all or part of the content without prior, express written authorisation, and to remove or manipulate copyright notices or technical protection devices.
06Content Submitted by Users
Where the user sends information or content of any kind to BLACKBAU through the enabled channels, the user declares, warrants and accepts that they are entitled to do so, that the information does not infringe any third-party rights and that it is neither confidential nor harmful to third parties, holding BLACKBAU harmless. Anyone who considers that content on the website infringes their rights may notify Hola@blackbau.com, providing identifying and contact details, documentation evidencing ownership of the rights, a detailed account and exact location of the infringement, and an express statement that the content is used without the rights holder's consent.
07Links
Links to third-party websites are managed by third parties, and BLACKBAU has no human or technical means to know in advance, control or approve their information, content, products or services, and therefore assumes no liability in respect of them. Links to BLACKBAU channels on social platforms are provided solely to facilitate access. Users may establish links to the website provided they do not reproduce its content, do not create a frame or border environment, do not make false or inaccurate statements or imply that BLACKBAU has authorised or supervised the linking site, and provided the linking site contains no unlawful content or content contrary to morality, public order, third-party rights or data protection rules.
08Rules of Use
Access to or use of the website for unlawful or unauthorised purposes is prohibited, in particular: using it in ways contrary to law, morality or public order; causing damage, interruptions or defects to its operation or to third-party equipment; transmitting, installing or publishing viruses or malicious code; collecting other users' personal data; registering with a false identity or impersonating third parties; gaining unauthorised access to any section, system, network or server by hacking, forgery or password extraction; breaching security or authentication measures; causing disproportionate saturation of the infrastructure; or hindering the normal operation of any activity available through the website. Breach may lead BLACKBAU to adopt appropriate legal measures, including deletion or blocking of the infringing user's account, with no entitlement to compensation.
09Liability and Warranties
BLACKBAU cannot guarantee the reliability, usefulness or truthfulness of all information, services and content on the website, nor of the documentation made available through it, and does not guarantee or accept responsibility for: the continuity of content, services or functionalities; the absence of errors in that content; the absence of viruses or other harmful components on the website or its server; the invulnerability of the website; the usefulness or performance of its content; or damage caused by any person infringing the conditions and instructions established by BLACKBAU. BLACKBAU declares that it has adopted all measures within its means and the state of the art to guarantee the operation of the website and minimise system errors. BLACKBAU is not liable for causes beyond its control, including force majeure, internet access problems, technological problems beyond its diligent and reasonable management, or acts and omissions of third parties.
10Suspension of the Website
BLACKBAU reserves the right to suspend, modify, restrict or interrupt, temporarily or permanently, access to, browsing of, use of, hosting of and/or downloading of content and use of the website's services, with or without prior notice, for users who breach any provision of this legal notice, without any entitlement to compensation.
11Data Protection
In accordance with Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights, all personal data collected during use of the website is processed as set out in the Privacy Policy, which every user must expressly accept where personal data is provided through the website.
12General Provisions
Clause headings are for information only and do not affect, qualify or extend the interpretation of this legal notice. BLACKBAU may amend these conditions in whole or in part by publishing the change in the same manner as this legal notice or by any communication addressed to users. The term of this legal notice coincides with the time of its display, until it is amended. Should any provision be declared null or unenforceable, this shall not affect the remaining provisions. Failure by BLACKBAU to exercise any right or condition does not constitute a waiver of it, save written acknowledgement and agreement.
13Governing Law and Jurisdiction
The regulations in force determine the applicable law and jurisdiction governing relations between BLACKBAU and users of the website. Where those regulations allow submission to a specific forum, Spanish law in force at the time of the facts shall apply, and BLACKBAU and users, expressly waiving any other forum, submit to the courts and tribunals of the city of Madrid (Spain).
